Zootopia Ltd: Contract Terms & Conditions relating to the purchase of a Ticket
These Contract Terms and Conditions are legally binding and contain the Agreement between The Client (The Guest(s)) and Zootopia Ltd (The Owner), relating to luxury accommodation and other services (Services).
A booking by a Client together with these Contract Terms and Conditions (communicated in writing, in person or electronically) and our FAQs, a copy of which can be found here: https://zootopia.uk/frequently-asked-questions/ will constitute the Client’s acceptance of, and agreement to be bound by, their contents.
Contract Terms and Conditions (The Agreement) may only be amended to the extent agreed in writing by The Owner.
1. Definitions
1.1 In these Contract Terms and Conditions words and expressions shall have their ordinary meaning unless otherwise defined within these Contract Terms and Conditions.
- Agreement (The) means these Contract Terms and Conditions.
- Booking Confirmation means the receipt issued by the Owner to the Client or Customer containing details of the Facilities, Dates and Purchase Charge.
- Client or Customer (The) is the person entering into an agreement with the Owner and who is Principal to all obligations to this Agreement.
- Services are all the physical items included in the purchase as detailed on the Owner’s tickets and/or website.
- Purchase Charge means the amount payable by the Client to the Owner as specified on our website. All Charges must be paid in full at the time of booking.
- Owner (The) is Zootopia, registered address: Stockton Dairy, Warminster, BA12 0SQ and/or their subcontractors or agents.
2. Booking Confirmation
2.1 A booking may only be deemed valid once The Client is in receipt of a sales receipt or ticket order confirmation from the Owner, also referred to as an E-ticket and will state an unique booking order number. The Owner will provide this subject to availability and upon full receipt of the Purchase Charge. This sales receipt / ticket order confirmation / E-ticket may come from a third party source.
2.2 Unless clearly stated on the booking confirmation and website no Purchase with the Owner will include entry to any event or include event tickets.
2.3 The images on our website are for illustrative purposes only. Although we have made every effort to display accurately, we cannot guarantee that all images reflect the accommodation you will stay in. Your accommodation may vary slightly from those images.
3. Client’s Responsibility
3.1 Zootopia takes no responsibility for loss or damage to the Clients personal items. Smoking and/or vaping and the charging of E-Cigarettes is prohibited when you are within or under any form of structure or enclosure.
3.2 The Client is responsible for themselves, any misconduct, aggressive behaviour or abusive language shall be treated accordingly, with removal of the Client from the Zootopia premises. We reserve the right to refuse admission to our campsite at any time in any circumstances where we deem it necessary for the protection of the security, safety and comfort of our other guests. In particular, we may refuse entry where you are found with prohibited items (as set out in the FAQs and the Event’s main site at www.glastonburyfestivals.co.uk or we feel you are engaged in anti-social behaviour. In such circumstances your accommodation booking will be cancelled and we shall not be obliged to refund any monies paid for the booking.
3.3 You shall not allow anyone other than yourself and those on whose behalf you make the booking to use the Services unless we expressly allow you to in writing. If The Client allows non-Ticket Holders into the Zootopia premises, we have the right to remove your entire party, ban you from using our Services or removal from the festival grounds should it be deemed necessary.
3.4 Wristbands removed from the wrist or tampered with will be rendered invalid and will not be replaced. Lost or missing wristbands will not be replaced. Those without wristbands will be refused admission to our campsite or may be removed from the campsite.
3.5 No artificial heating is to be used inside the Equipment. You are not to use any lighting, heating, cooking or other gas or electrical appliances inside any of our Equipment, apart from what The Client has provided. You are not to light, or allow to be lit, any fire, candle or other naked flame within or close to the Equipment.
3.6 If on arrival at the campsite the accommodation we have supplied appears to be in an unsatisfactory condition you should notify one of our staff immediately and no later than 24 hours after your arrival at the campsite. In such an instance, we will use reasonable efforts to rectify the defect or change your accommodation as soon as is reasonably practicable but we cannot guarantee this will always be possible due to availability. If you fail to notify one of our staff within 24 hours of checking in then we cannot give any assurance that we will be able to supply you with different accommodation.
3.7 If at any time after you arrive at the Event the accommodation becomes damaged other than as a result of your actions or the actions of others using the accommodation, you should notify one of our staff immediately. Following inspection by one of our staff, if considered necessary and if a repair or replacement is available, we will use reasonable efforts to change or repair the damage as soon as is reasonably practicable. If we are to change your accommodation we will provide you with alternative accommodation of the same or similar specifications and quality to that which you booked.
3.8 The accommodation must be left at the end of an Event in the same condition as when it was first provided, subject to any fair wear and tear that is consistent with normal and reasonable use. We may retain the credit or debit card details provided to us when you make a booking and reserve the right to deduct an amount equivalent to the cost of repairing or replacing the accommodation or any part of it to the extent it is not returned to us in the same condition as when it was provided to you. The lead booker (i.e. the person making the booking on behalf of others) accepts liability for any loss or damage to accommodation incurred during the hire period.
3.9 The Services and accommodation will only be available for use during the dates and times specified by us when we confirm your booking. If you arrive at our campsite before the “opening time” specified you will not be permitted to enter the campsite or use the Services or accommodation until that time. You must vacate the campsite and take all your possessions and belongings with you before the specified “closing time” at the end of the hire period.
4.0 The accommodation and all equipment forming part of it shall remain our property at all times unless we have expressly confirmed otherwise to you.
4.1 The accommodation will only be suitable for weather conditions to the extent described by the relevant manufacturers’ information or guidelines and we will not be responsible for any damage or loss you may suffer as a result of adverse weather conditions.
4. Payment
4.1 All payments must be made in advance of the event. Details of the prices of all our Services are available on our website. We may vary these prices from time to time and you are advised to check our current prices before making any booking. The price you will pay for the Services we supply to you will be the price displayed on our website at the time you make the booking (unless there is an error on the website).
4.2 All payments made online are subject to a ticketing fee taken by a third party and VAT which are both clearly displayed when booking.
4.3 Subject always to clause 4.4, you may alter your booking at any time up to 30 days prior to the Event. If the altered Services you require are more expensive than those originally booked you must pay the difference at the time you alter the booking. If the altered Services you require are less expensive than under the original booking we may, at our absolute discretion, refund to you the difference in the two prices, but we are under no obligation to do so.
4.4 Any alteration to your booking in accordance with clause 4.3 will be subject to availability and space at our campsite. We will always try our best to meet your requirements for an altered booking but if we are unable to do so your original booking will still be valid or you may ask for a refund.
4.5 Your booking is personal to the lead booker and those persons on whose behalf a booking was made. This means that you cannot transfer, sell or give away your booking to any other person. Please contact us in the first instance you wish to transfer your Ticket.
4.6 We do not take responsibility if you purchase your tickets through a third party seller and we will not be held liable for any miss-sold, duplicate or fraudulent tickets.
5. Refunds
5.1 The Client will receive a full refund, if The Client wishes to be refunded via the same payment method and gives notice of cancellation no less than 30 days prior to the Event taking place. The refund however may be subject to a ticketing fee that may not be refundable. Notice is deemed when the Client requests their refund via their account or they email info@zootopia.uk including the booking number with their request for a refund. If the Client requests an alternative refund method, ticketing fees will have to be deducted from the due refund.
5.2 If The Client requests their refund via their account or they email The Owner less than 30 days prior to the Event, The Owner is under no obligation to refund The Client. If The Owner has a waiting list or deems it possible to put the Ticket live on its website, they will do so, but this does not guarantee The Client a refund, only if that Ticket is resold, can we refund The Client.
5.3 If the Event for a particular year is cancelled for any reason but the Event will be held the following year, you may roll over your booking for Services to the following year. If you are unable to attend the Event for the following year then you may cancel your booking and we will issue you with a refund.
5.4 If the Event is abandoned after it has started any refund we give you will be at our sole discretion.
6. Loss and Damage
6.1. All of the client’s possessions are the sole responsibility of the client.
6.2 The Owner does not take any responsibility for any loss or theft that may occur before, throughout or after the event at our campsite or car park.
6.3 The Owner will not refund or reimburse the sum of the loss or theft to the client.
7. Liability to Third Parties
7.1 You accept that the limitations of our liability set out above are reasonable in all the circumstances. Nothing in these terms will limit or exclude our liability to you for death or personal injury arising as a result of our negligence or the negligence of our employees or agents, or for any other matter which would be unlawful for us to exclude or limit.
7.2 The Client expressly acknowledges that The Owners are not the original manufacturer or supplier of the equipment. The Owner accepts no liability for any injury or death from any claim or proceedings arising from this contract with The Client.
7.3 The Owner will hold the client’s data securely and not pass his/her personal information on to any other third party unless demanded and required to under the law of the United Kingdom.
7.4 We shall not be in breach of these terms nor liable to you for delay in performing, or failure to perform, any of our obligations under these terms if such delay or failure results from events, circumstances or causes beyond our reasonable control. This includes where the Event is cancelled due to an event, circumstance or cause beyond our reasonable control, including but not limited to the following:
(a) acts of God, flood, drought, earthquake or other natural disaster;
(b) epidemic or pandemic;
(c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;
(d) nuclear, chemical or biological contamination or sonic boom;
(e) any law or any action taken by a government or public authority, including without limitation imposing an export or import restriction, quota or prohibition, or failing to grant a necessary licence or consent; and
(f) interruption or failure of utility service.
For the avoidance of doubt, if the Event is cancelled due to an event, circumstance or cause beyond our reasonable control (such as those listed above) then clauses 5.3 and 5.4 will apply.
8. Photography
Zootopia Ltd and its partners occasionally take photos and record video at our site for marketing and promotional purposes, including website use and on social media. You acknowledge that such photos and videos may include you or your guests during your stay at our site. You consent to their use for these marketing and promotional purposes, and you release Zootopia Ltd and its Partners from any claim from you or anyone else arising out of the use of the photo and video. We will use our reasonable endeavours to ensure that your privacy is not compromised.
